1 Scope of application
These General Terms and Conditions apply to all services provided by AudioNova-Musicstudio to its customers.

2 Conclusion of contract
A contract between the customer and the AudioNova-Musicstudio is concluded
when the customer places an order in writing or verbally or by telephone
and the recording studio confirms this order in writing.

3 Services
The AudioNova-Musicstudio provides services in the field of sound recording, sound editing and music production.
The concrete services result from the contract concluded between the customer and the recording studio.

4 Prices
The prices for the services of the AudioNova-Musicstudio result from the price list valid at the time,
or the individual offer made by the AudioNova-Musicstudio or a combination of both.
All prices are exclusive of the statutory value added tax.

5 Terms of payment
Payment for the services shall be made by the customer within 14 days after invoicing.
Unless otherwise agreed in writing: 40% of the net sum of the order volume aimed at for the production must be paid to AudioNova-Musicstudio by bank transfer before the start of the production. This advance payment cannot be claimed back. The remaining sum is due upon delivery of the finished product according to the order.
In case of delayed payment, AudioNova-Musicstudio is entitled to charge interest on arrears in the amount of 5% above the respective base interest rate.

6 Retention of title
AudioNova-Musicstudio retains ownership of all products/files created in connection with the services,
until full payment of all outstanding claims. All products/files will be handed over to the customer only after complete payment
or dispatched at the request of the customer. The customer has no right of use until full payment has been received.

7 Rights of use
All rights of use of the works produced in the AudioNova-Musicstudio remain with the customer.
The AudioNova-Musicstudio is entitled to use the produced works for self-promotion purposes.

8 Data protection
The AudioNova-Musicstudio commits itself to comply with the data protection regulations and to treat the customer’s data confidentially.

9 Compensation for failure
Should the customer fail to keep an agreed appointment without cancelling it at least 24 hours in advance,
AudioNova-Musicstudio reserves the right to charge a cancellation fee of 50%.
This compensation is independent of any claim for damages by AudioNova-Musicstudio and is to be paid by the customer as a lump sum.

10 Liability
The customer is liable for all damages he causes during his stay at the AudioNova-Musicstudio, to its equipment or property.
The liability also extends to damages caused by third parties brought to the AudioNova-Musicstudio by the customer.
The customer is obliged to take all necessary measures to avoid damages.
Should damage nevertheless occur, the customer is obliged to report this immediately to the AudioNova-Musicstudio
and to pay for the repair of the damages.

11 Changes of the terms and conditions
AudioNova-Musicstudio reserves the right to change these terms and conditions at any time.
The amended terms and conditions will be made available to the customer in text form.

12 Final provisions
Should any provision of these General Terms and Conditions be or become invalid,
this shall not affect the validity of the remaining provisions. The ineffective provision shall be replaced by a provision
which comes closest to the economic sense and purpose of the invalid provision.
The law of the Republic of France shall apply. The place of jurisdiction is the registered office of AudioNova-Musicstudio.
